Terms of Use and Privacy Statement

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and scrunchzie ("Company", “we”, “us”, or “our”), concerning your access to and use of the scrunchzie.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason.  It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.
By creating a Scrunchzie affiliate account, you have read the scrunchzie.com Terms of service and privacy Policy and agree to abide by them. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Media Release
By creating a Scrunchzie affiliate account, all affiliates 18 years of age and older are automatically agreeing to our media release policy. This means, at Scrunchzie's sole discretion, affiliates who create custom advertisements for their following, included but not limited to video content and photography, may have their content used in official Scrunchzie advertisement campaigns, social media programs, and website content. Influencers, affiliates, and advertisers under the age of 18 are not under Scrunchzie's media release policy and will not have their content used. Scrunchzie affiliates have the option to opt-out of our media release policy. To do this, an affiliate, influencer, or advertiser MUST contact affiliates@scrunchzie.com and request to opt out BEFORE their content is used. After opting out, Scrunchzie will provided them with a formal document ensuring their content will not be used. After the affiliate's, influencer's, or advertiser's content is used, they are ineligible to opt out of Scrunchzie's media release policy. By not opting out of Scrunchzie's media release policy you agree to the following:

1. Scrunchzie is not obligated to notify me when my content is used in an advertising campaign, social media program, or website promotion. Scrunchzie is also not obligated to associate my name, social media accounts, website, or platform with their promotions. Scrunchzie is also not obligated to associate my discount code or tracking link with their promotions. (Obligation entails that Scrunchzie may or may not do the aforementioned, and it is under no obligation to do so.)
2. Scrunchzie will not maliciously edit or disseminate information with an affiliate's custom content. Scrunchzie will do its utmost to maintain the integrity of the content an affiliate, influencer, or advertiser provides. This, however, is at the sole discretion of Scrunchzie and by agreeing to the media release policy, the affiliate, influencer, or advertiser acknowledges this risk.
3. The affiliate, influencer, or advertiser, hereby waves any right to inspect or approve the finished photographs, videos, or electronic matter that may be used in conjunction with them now or in the future, whether that use is known or unknown, and the affiliate, influencer, or advertiser waives any right to royalties or other compensation arising from or related to the use of their content.

Federal Trade Commission Law
In the US, if you use affiliate links on your website, social media platform, or other platform, you are required by the FTC (Federal Trade Commission) to disclose this. If you stand to make money or receive any sort of benefit - financial or otherwise - from your recommendation or endorsement of a product or service, you must disclose this to the public. By failing to disclose this, you as the affiliate, influencer, or advertiser take sole responsibility for all legal repercussions, and Scrunchzie is not responsible for any liabilities. Scrunchzie does not influence how an affiliate, influencer, or advertiser discusses our products or platform. The affiliate, influencer, or advertiser may discuss the product, company, Site, and its other facilities in any light they so choose. Scrunchzie does not sway the opinions of our affiliated users.

Payment
By creating a Scrunchzie affiliate account, you agree to the set commission, payout time, and payment procedures. By using an affiliated account, you agree not to dispute, challenge, or negotiate a payment informally, formally, or on a legal basis. In the unlikely event that Scrunchzie and its associated platforms shut down or switch ownership, you agree to the compensation and policies provided and will not dispute, challenge, or negotiate them informally, formally, or on a legal basis.

Account Termination
Although rare and only occurring in extreme cases, Scrunchzie's management may decide than an affiliate no longer aligns with Scrunchzie's values and will remove their account. Accounts removed for this reason will be done at the sole discretion of Scrunchzie. Scrunchzie will also remove accounts after 2 consecutive months of $0 sales or if an affiliate fails to reach the $30 minimum commission after 3 months of owning an approved affiliate account. If an account is terminated, the affiliate will receive an email. By using an affiliated Scrunchzie account, you will not dispute, challenge, or negotiate a termination formally or on a legal basis.
