Affiliate Agreement & Terms of Service

This Affiliate Agreement (“Agreement”) is entered into between Marta Stebnicka-Lebre (“Company,” “we,” “us”) and you (“Affiliate,” “you”). By joining our affiliate program, you agree to the following terms:

1. Enrollment

• To become an Affiliate, you must complete the registration form truthfully.
• We review all applications and may accept or reject at our sole discretion.
• You may not participate if your website or promotional methods include illegal, misleading, or offensive content.

2. Commissions

• You will earn 20% commission on net sales of website templates referred through your affiliate link.
• Commission is calculated on the product price only (excluding taxes, discounts, refunds, or chargebacks).
• Refunds or cancellations void the related commission.
• Rates for services (custom design, SEO) may vary and will be disclosed separately.

3. Tracking & Attribution

• Tracking is handled via our affiliate software (Affiliatly).
• Our cookie duration is 45 days. If a user purchases within that period after clicking your link, you receive credit.
• The last valid referral link clicked before purchase is credited.

4. Payment

• Payouts are made monthly via PayPal.
• Minimum payout threshold: $100 USD. Unpaid balances roll over until threshold is reached.
• Affiliates are responsible for providing correct payment details and covering any transfer fees.

5. Promotional Guidelines

Affiliates agree:

• To promote honestly and not make false claims about our products.
• To clearly disclose affiliate relationships in compliance with FTC and other applicable regulations. Example: “I may earn a commission if you purchase through my link.”
• To mark affiliate links as rel="sponsored" or rel="nofollow" in compliance with Google’s guidelines.
• Not to run paid ads targeting our branded keywords (“Marta Lebre Designs,” “martalebre.com,” template names, etc.).
• Not to engage in spam, cookie stuffing, or deceptive tactics.

6. Intellectual Property

• You may use our approved images, product screenshots, and logos to promote.
• You may not modify our branding or present yourself as an employee/owner of Marta Lebre Designs.

7. Term & Termination

• This Agreement begins upon your acceptance and continues until terminated.
• Either party may terminate at any time with written notice.
• We reserve the right to suspend or terminate accounts immediately in case of fraud, misuse, or policy violation.

8. Limitation of Liability

• We are not liable for indirect, incidental, or special damages arising from participation in the program.
• We do not guarantee any specific level of income; your results depend on your own efforts and audience.

9. Changes

• We may modify commission rates, policies, or these Terms at any time.
• Updates will be communicated via email or posted in your affiliate dashboard.
• Continued participation constitutes acceptance of the new terms.

10. Governing Law

• This Agreement shall be governed by the laws of Poland, without regard to conflict of law rules.
